The MPS Difference

 

ACHIEVE LICENSE AND SUBSCRIPTION TERMS & POLICIES, when purchased via Purchase Order:

By purchasing Achieve Online Courseware (“the Courseware”) from BFW Publishers (“the company”), you agree to the following subscription terms. Issuance of a purchase order based on this quote signifies your acceptance of these terms:

  1. License Purchase. With respect to each product, the number of licenses allocated to you will be determined by multiplying the quantity by the number of uses (where use = year) (Example: 100 units of a 6-use product = 600 licenses.)
  2. Subscription Duration. The duration of the subscription is denoted by the term "uses," which equates to "years." (Example: 6-use = 6 years.)
  3. License Expiry and End Date. Access to the Courseware will expire on the first to occur of
    1. all purchased units which would be available over the course of the number of uses have been utilized, or
    2. the number of uses has transpired utilizing the following calculation for use expiry: utilizing August 1 as the start of a new year,
      1. If the invoice date falls between January 1 and September 30, the end date shall be calculated as the invoice year plus the number of uses indicated (Example: 100 units of a 6-use product is invoiced on April 15, 2023. The end date based on uses purchased = July 31, 2029); and
      2. If the invoice date falls between October 1 and December 31, the end date shall be calculated as invoice year plus the number of uses indicated + 1. (Example: 100 units of a 6-use product is invoiced on November 15, 2023. The end date based on uses purchased = July 31, 2030.)
  4. License Overages and Grace Period. During your subscription period, the company will diligently monitor the quantity of licenses utilized for a license overage. A license overage occurs when the overall number of licenses used exceeds the quantities purchased. In the event of a license overage, you will be notified and invoiced for the overage. You have a grace period until the course end date in which to pay for the license overage. Non-payment may result in interrupted access.
    The company reserves the right to monitor and control the number of licenses in use, taking necessary action in case of any breach of these terms. Customers are encouraged to conduct their own regular review of license usage against purchased quantity. Understanding and adherence to these terms are incumbent upon the customer. Non-compliance may lead to consequences, including financial liability and suspension of access.
  5. License Transfer. The license(s) allocated under this agreement are non-transferable. However, an exception is made for the accelerator option, which when purchased, permits the transfer of the license once before the subscription end date.
  6. Accelerator Option. The "Accelerator Option" if chosen at the time of initial purchase, permits the one-time option to upgrade to a new edition at any time within your active Courseware subscription. To obtain the Accelerator Option, a one-time fee is required, which may be bundled with the purchase of a print book to offer an overall discount; however, the fee remains fixed and does not decrease. The Courseware can only be updated once throughout the life of the subscription, and it is your responsibility to inform your sales representative when you are ready to proceed with the update. If you do not know your sales representative, you can find them here. You have the flexibility to skip editions and are not obligated to follow a sequential update process. The Accelerator Option applies exclusively to digital products, and any print products are not eligible for update.

Return Criteria

Unused digital license product purchases are eligible to be returned for credit only. Unused digital licenses approved for return will be deactivated before credit is issued. No partial returns are permitted.

Window for Returns

Request for return may be made within 12 months of the invoice date, unless otherwise authorized and except for out-of-print titles. Out-of-print titles will be eligible for return for up to 180 days after notification only. Returns on titles that have been out of print for more than 180 days are not eligible for credit. Credit memos should be used within one year from date of issuance. All deductions in payments should reference the actual credit memo number and be accompanied by a complete explanation, which will allow us to resolve the deduction in a timely manner.

Method of Return

All returns must be prepaid. No prior authorization required. If returned collect, shipments will be refused, unless prior authorization was granted.

Shipping Requisites

Enclose packing slip with shipment, giving:

  • Invoice number
  • Your account number
  • Date of purchase
  • Reason for return
  • Detailed list of contents-including quantity, ISBN and title

Crediting of returns without this information will be delayed.

Credit and Return Criteria

Books must be in unmarked, saleable condition with no bookseller stickers added and with no Macmillan Learning or Bedford, Freeman & Worth stickers removed.

Added Stickers

A book with any type of proprietary or secondary sticker or label applied (e.g., price or bar code stickers, rental or used stickers) will be considered as not being in saleable condition and will not be eligible for credit. These books will be returned to sender (for chains, the return will be to the central location) via a carrier of the sender’s choice at the expense of sender (the party seeking the return).

SQR Stickers

Macmillan Learning and Bedford, Freeman & Worth add SQR code stickers to certain of our books for anti-piracy purposes. These stickers should not be removed. Books from which these SQR code stickers have been removed (even if the residue is removed) are not eligible for return or credit and will not be returned to sender.

Counterfeits

If the book is deemed to be counterfeit, credit will not be issued and will not be returned. We reserve all of our rights with respect to counterfeit books.
